2.2 – Detained vs. Arrested – What’s the Difference?: Being detained means you are temporarily stopped because police suspect something and want to ask questions. It does not mean you are under arrest yet. An arrest happens when they officially take you into custody and you are not free to leave. Knowing the difference matters because your rights change at that moment. During detention, you can ask politely, “Am I free to go?” If they say no, you are likely under arrest. If they say yes, you should leave calmly and quietly. Never run or argue. Officers look for body language and tone to decide what happens next. Understanding these stages keeps you from panicking or saying too much. It also shows that you know your rights without being aggressive.
