11.2 – Dealer vs. Private Sales: Legal Differences You Should Know: Buying from a licensed dealer and buying from a private seller are legally very different experiences, each carrying distinct protections and risks. Dealers must follow consumer protection laws, disclose prior damage, and provide accurate vehicle history information. Many states also require dealers to offer limited warranties or guarantee clear titles. Private sellers, however, are usually exempt from these obligations and sell vehicles “as is,” meaning once money changes hands, the responsibility for problems shifts entirely to the buyer. When dealing with a dealer, request every agreement in writing—sales price, financing details, taxes, and fees—and confirm that the contract lists no optional items you did not authorize. For private sales, verify the seller’s ownership and identification, and always meet in safe, public locations. Complete a bill of sale that includes date, VIN, mileage, and signatures from both parties. Never skip a title check through the DMV or an online record service to ensure the vehicle isn’t stolen or encumbered by debt. Dealers may offer financing and registration assistance, but private sales often require you to handle these steps yourself. The core difference lies in accountability: dealers answer to consumer regulators, while private individuals do not. Understanding these contrasts empowers you to negotiate, verify, and finalize your purchase with full awareness of your legal position and future responsibilities.
