6.7 – Eviction Process and Your Legal Defenses: Eviction is a legal process, not an immediate removal, and knowing your rights during it can prevent homelessness and injustice. A landlord must file a court case—called an unlawful detainer or eviction notice—before removing a tenant. You have the right to receive notice, respond in court, and present your defense. Common defenses include lack of proper notice, unsafe living conditions, or retaliation for exercising legal rights. Never ignore court papers; respond promptly and attend hearings. If you lose the case, you still have time to move or appeal before enforcement. Keep all communication documented, and seek help from tenant advocacy groups immediately. Understanding the process turns fear into action, helping you navigate conflict with composure and fairness.
