11.34 – How to Legally Gift a Car and Avoid Tax and Title Issues: Gifting a vehicle is generous, but it must be executed correctly to prevent tax penalties and ownership confusion. Begin by confirming your state’s definition of a “gift” transaction—some require notarized affidavits declaring that no money changed hands. Sign the title to the recipient and write “gift” in the purchase-price section of the bill of sale. Both parties should present identification during notarization if required. The recipient is typically responsible for title transfer fees and any minimal taxes assessed on the fair-market value. If a lien exists, it must be released before gifting; lenders cannot simply “hand off” financed cars. Contact your insurer to remove the car from your policy once transfer is complete. Keep copies of the notarized paperwork for your financial records. Never disguise a sale as a gift to avoid taxes—doing so constitutes fraud. Proper gifting strengthens relationships while honoring legal transparency. When generosity and compliance intersect, your goodwill remains intact, free from future liability or misunderstanding.
